1. Acceptance of Terms

By accessing or using Squad 9 Baseball ("the App"), available at squad9baseball.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the App. If you are under 18, your parent or legal guardian must review and accept these Terms on your behalf before you use the App.

2. Description of Service

Squad 9 Baseball is an interactive baseball training application operated by Atkin Enterprises, LLC (doing business as Squad 9 Baseball) and available at squad9baseball.com. It provides defensive scenario quizzes, coaching tools, and performance tracking for baseball players, coaches, and teams of all ages, including children and youth players. The App is intended to supplement traditional baseball instruction by reinforcing defensive fundamentals, situational awareness, and decision-making skills in an engaging, game-based format.

3. Educational Purpose and Use by Minors

The App is designed as an educational tool for youth baseball players, teams, and coaches.
All content is age-appropriate and focused on teaching baseball defensive fundamentals, rules, and situational decision-making.
The App does not contain advertising or in-app purchases targeted at children.
The App does not include open messaging or social features. However, coaches may send pregame prep assignments to players on their team through the App. These assignments are delivered via automated email notifications sent from squad9baseball.com to the player's registered email address. Coaches cannot compose free-form messages; they can only select scenarios from the App's existing content library and assign them to players. All assignment emails are system-generated and contain a link back to the App.
Parents and coaches are encouraged to use the App alongside young players to guide their learning experience.
We take the privacy of young users seriously. We require verifiable parental consent before users under 13 can access the App, and we limit the data we collect from minors. See our Privacy Policy for details on how we handle data for users under 13.

4. User Accounts

You must provide a valid email address to create an account.
You are responsible for maintaining the confidentiality of your password.
You are responsible for all activities that occur under your account.
Users under 13 must have verifiable consent from a parent or legal guardian before using the App. During account setup, users under 13 are required to provide a parent or guardian's email address. A verification code is sent to that email to confirm consent.
Users aged 13 to 17 may create their own account with parental consent.

5. Acceptable Use

You agree not to:

Use the App for any unlawful purpose.
Attempt to gain unauthorized access to any part of the App.
Interfere with or disrupt the App or its servers.
Share your account credentials with others.
Use automated tools to access the App.
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying algorithms, or data models of the App.
Copy, reproduce, distribute, or create derivative works based on the App or any of its content without prior written permission from Atkin Enterprises, LLC.

6. Payments and Subscriptions

The App offers a limited free trial so you can evaluate core features before purchasing. The free trial includes one game and two Play Animator views.
After the free trial, a paid subscription is required to access the full App, including unlimited games, unlimited Play Animator views, coach tools, pregame prep assignments, and team management features.
Subscription fees are charged through Stripe, a secure third-party payment processor. By subscribing, you authorize Stripe to charge your selected payment method.
Subscriptions are billed on a seasonal basis and provide access through the end of the current season (December 31 of the subscription year).
All subscription fees are non-refundable. See our Refund & Return Policy for full details.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period, and you will retain access until that date. No partial refunds or prorated credits will be issued.
We reserve the right to change subscription pricing with at least 30 days' written notice sent to your registered email address. Price changes will not affect your current billing period.

7. Intellectual Property

All content, design, graphics, and software in the App are owned by Atkin Enterprises, LLC and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without written permission.

8. Disclaimers

The App is provided "as is" without warranties of any kind.
We do not guarantee that the App will be uninterrupted or error-free.
Training content is for educational purposes only and does not replace professional coaching, medical advice, or in-person instruction.
The App is not a substitute for proper supervision during physical baseball activities.

9. Indemnification

You agree to indemnify, defend, and hold harmless Atkin Enterprises, LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any third party's rights. For accounts held by minors, the parent or legal guardian who consented to these Terms assumes this indemnification obligation.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Any legal action arising from these Terms shall be filed in the state or federal courts located in Cook County, Illinois.

11. Dispute Resolution

Any dispute arising from these Terms or use of the App shall first be resolved through good-faith informal negotiation by contacting us at support@atkin.tech. If the dispute is not resolved within 30 days, either party may pursue binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Cook County, Illinois. Both parties waive the right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property violations.

12. Limitation of Liability

To the maximum extent permitted by law, Atkin Enterprises, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion, with notice sent to your registered email address.
You may terminate your account at any time by contacting us at support@atkin.tech. Upon termination, we will delete your account data within 30 days, except where retention is required by law.
For accounts of users under 13, a parent or legal guardian may request termination and deletion at any time by emailing privacy@atkin.tech.

14. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms.
